TCPA Consent Disclosure

This disclosure outlines how ChosenCRM handles consent for telephone and electronic communications in compliance with the Telephone Consumer Protection Act (TCPA) and related regulations.

Consent Collection

ChosenCRM provides tools for loan officers and mortgage professionals to collect, track, and manage borrower consent for communications including phone calls, SMS/text messages, and emails. All consent records are timestamped and stored with full audit trails.

Types of Consent

  • Express Written Consent: Required for telemarketing calls and promotional text messages. Collected via signed forms or electronic opt-in with clear disclosure language.
  • Express Consent: Required for non-marketing calls and texts related to existing business relationships, such as loan status updates and appointment confirmations.
  • Opt-Out Rights: Borrowers can opt out of communications at any time. ChosenCRM automatically processes opt-out requests and updates contact preferences across all communication channels.

Do Not Call (DNC) Compliance

ChosenCRM maintains internal Do Not Call lists and provides tools to scrub contact lists against state and federal DNC registries. Loan officers are responsible for ensuring DNC compliance in their jurisdictions.

Call Recording Disclosure

When call recording is enabled through the ChosenCRM Power Dialer, users are responsible for providing appropriate disclosure and obtaining consent as required by applicable state and federal laws, including two-party consent states.

SMS Messaging

Text messages sent through ChosenCRM comply with TCPA requirements and carrier guidelines. Each message thread includes opt-out instructions. Message frequency and content can be controlled through automation settings and compliance rules.

Data Retention

Consent records, communication logs, and opt-out requests are retained for the duration required by applicable regulations. Organizations can configure retention policies through the admin dashboard.
